NGT serves notice in Bhendi Bazaar redevelopment project

The National Green Tribunal (NGT), Pune, on March 20 issued a notice in Saifee Burhani Upliftment Trust (SBUT)'s Bhendi Bazaar redevelopment project and directed that a committee be set up to inspect and verify factual aspects of a complaint of alleged infringement of environmental clearance.

The committee is to comprise State Level Environment Impact Assessment Authority (SEIAA), Maharashtra, State Pollution Control Board, Municipal Corporation of Greater Mumbai and Mumbai suburban collector. They will inspect and verify the project and submit a report via email to NGT before the next hearing on April 30.

The order, passed ex-parte, was on a complaint filed by one Sayyed Usman that 25% recreation ground spaces have not been provided on "virgin land" and have been provided on a podium with "no scientific disposal of construction waste". NGT directed the applicant to furnish requisites in a week.

"These are baseless allegations. We are glad the court has asked the petitioner to submit facts," said an SBUT spokesperson, adding the project complies with Development Control Regulations.

NGT panel of Justices S P Wangdi, S K Singh and expert members Dr S S Garbyal and Siddhanta Das in the order said, "In the event allegations are found to be correct, appropriate action in accordance with law will be taken against the project for mitigation, which may include rectification of infractions as well as assessment and payment compensation for damage."
